Please read these Terms and Conditions (“Terms”) carefully before using the Sako mobile application.
Interpretation and Definitions
Interpretation
Capitalised words have the meanings set out below. The same definitions apply whether the terms appear in singular or plural form.
Definitions
- Application means the Sako mobile application provided by the Company and installed on any Device.
- Application Store means any digital marketplace where the Application is distributed, including the Apple App Store and Google Play Store.
- Company (referred to as “the Company”, “We”, “Us” or “Our”) refers to Sako.
- Device means any device capable of accessing the Service, such as a smartphone or tablet.
- Service refers to the Application and any related websites, features, or content.
- You means the individual accessing or using the Service, or the company or legal entity represented by that individual.
Acknowledgment
These Terms govern Your use of the Service and constitute a binding agreement between You and the Company. By accessing or using the Service, You agree to be bound by these Terms. If You do not agree with any part of the Terms, You must not use the Service.
You represent that You have the legal capacity to enter into a binding agreement in Your jurisdiction. Your use of the Service is also subject to Our Privacy Policy, which describes how We collect, use, and share Your information, including location and usage data.
Food Information and Location Data
The Service surfaces healthy meal options and restaurant information based on Your location. To show nearby restaurants, the Application requests access to location data from Your Device. By using Sako, You consent to this data being collected and processed in accordance with Our Privacy Policy.
You understand that all menu information, nutritional tags, restaurant details, and availability are sourced from third parties and may not be accurate. Restaurants may change their menus, ingredients, or portion sizes at any time. The Company does not guarantee the accuracy of any menu or nutritional information.
No Medical Advice
The Service provides meal suggestions and nutritional information for general informational purposes only and does not constitute medical or dietary advice. Always consult a qualified healthcare professional before making significant changes to your diet or nutrition plan. The Company is not responsible for any health issues, allergic reactions, or conditions resulting from food choices made using the App.
Allergies and Dietary Restrictions
You are solely responsible for verifying ingredients and allergens with restaurants before ordering. The Service may display meal tags (such as “High Protein” or “Low Calorie”) for guidance only. The Company does not guarantee that any meal is free from allergens, cross-contamination, or specific ingredients.
Third-Party Services
The Application integrates third-party services including RevenueCat (subscription management), PostHog (analytics), and Expo (app infrastructure). We do not control these services and are not responsible for their content, availability, or reliability. Your use of any third-party service is governed by that service's own terms and privacy policy.
Subscriptions and In-App Purchases
Subscription Period
Some features are available only through a paid subscription. Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
Cancellation
You can cancel Your subscription at any time in Your device's Apple ID settings (iOS) or in Google Play → Payments & Subscriptions (Android). Cancellation takes effect at the end of the current billing period. We do not issue partial refunds.
Billing and Price Changes
All billing is handled by the applicable Application Store. Subscription prices may change. If pricing changes, You will be notified by the Application Store, and continuing to use the Service after the change takes effect constitutes acceptance of the new price.
Intellectual Property
All content, branding, and software within the App are the property of Sako or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our explicit written consent.
Termination
We may suspend or terminate Your access to the Service immediately, without notice, if You violate these Terms. Upon termination, Your right to use the Service will end.
Limitation of Liability
To the fullest extent permitted by law, the Company is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of Your use of, or inability to use, the Service. This includes errors in menu or nutritional data, food-related injuries or reactions, or third-party service failures.
“AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Company makes no warranties of any kind regarding accuracy, reliability, or availability. We do not guarantee that the Service will meet Your expectations, be error-free, or uninterrupted.
Governing Law
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.
Dispute Resolution
If You have a dispute with Us, You agree to first contact Us at support@creatorwhale.com and attempt to resolve the matter informally before pursuing any formal legal action.
Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new effective date. Continued use of the Service after updates means You accept the revised Terms.
